Protecting your privacy is important to KleanOutdoors, LLC (“KleanOutdoors”).  This Privacy Policy applies to your access or use of www.kleanoutdoors.com and all subdomains of www.kleanoutdoors.com (collectively, the “Site”), as well as to your access or use of any of the mobile applications related to said websites (collectively, the “Applications”).

The terms “we,” “our,” “ours,” and “us” refer to KleanOutdoors and the terms “you,” “your,” and “yours” refer to any user of the Site and/or the Applications. If you are under the age of eighteen (18), you may use the Site or any of the Applications only with the permission of a parent or legal guardian.  This Privacy Policy identifies how we collect, use, store, disclose, share, sell, license, transmit and transfer information from or about you. Binding Effect

BY ACCESSING OR USING THE SITE OR ANY OF THE APPLICATIONS, YOU REPRESENT AND WARRANT THAT YOU UNDERSTAND, FULLY AGREE WITH AND CONSENT TO THIS PRIVACY POLICY AND THE TERMS OF USE AND ANY AND ALL AMENDMENTS OR MODIFICATIONS MADE THERETO IN OUR SOLE AND ABSOLUTE DISCRETION. IF YOU DO NOT AGREE AND CONSENT TO SUCH, DO NOT USE THE SITE OR ANY OF THE APPLICATIONS. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, THE APPLICATIONS OR WITH ANY OF THIS PRIVACY POLICY OR THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO NOT USE OR DISCONTINUE USING THE SITE AND/OR THE APPLICATIONS.

1. The Information We Collect.

Whenever you create a username and password, comment in a forum, journal entry, or otherwise interact with the Site or the Applications, we may collect data and information. There are at least two kinds of data and information we may obtain from or about you: (a) Anonymous Information and (b) Identifiable Information.

(a) Anonymous Information includes the following: data or information that does not permit us to  directly identify you personally, aggregate data or information that we use to administer the Site and/or the Applications, and all other data or information that we cannot use to directly identify you (collectively, “Anonymous Information”), such as but not limited to, your browser type and language, your Internet Protocol (“IP”) address, domain names, access times and referring website addresses. We reserve the right to retain third parties to help us collect, aggregate and otherwise use Anonymous Information. Nothing in this Privacy Policy is intended to create any contractual relationship or rights between you and any third party or to create any other legal rights on behalf of any third party with you.

(b) Identifiable Information includes the following: any data or information that identifies you personally, such as but not limited to your name, the organization you represent, your email address, your physical address or location, your telephone number, your debit/credit card information, your bank routing and account information, your user account information, and all other data or information that we can use to identify you (collectively, “Identifiable Information”).

We treat any Anonymous Information that is combined with Identifiable Information as Identifiable Information. By using the Site or any of the Applications, you authorize us to collect, use, store, disclose, share, sell, license, transmit and transfer your Identifiable Information to third parties at our sole and absolute discretion.

We may request that you create an account by providing Identifiable Information and creating a user ID and password. We will use this information to maintain your account. We may also use this information to send you announcements of new features on our Site or Applications, special offers, and promotional and other materials that we think you may be interested in. You may elect not to receive such information by opting out. We have the right to refuse you service, access to or use of the Site and any of the Applications, to terminate your account, to monitor your account and activities on the Site and any of the Applications, without notice, in our sole and absolute discretion.

2. How We Use Gathered Information.

We may use Anonymous Information and Identifiable Information in various ways or reasons, such as but not limited to the following:

(a) Anonymous Information: Anonymous Information may be used internally for Site and application administration, troubleshooting, data analysis, auditing, and research to help improve the quality of the Site and the Applications and their design. We may share Anonymous Information, such as demographics, with existing and prospective business partners and advertisers.

(b) Identifiable Information: Identifiable Information may be used for various purposes, including administration of the Site and the Applications and communications with you about products and services. From time to time, we may use your Identifiable Information to send important notices, such as communications about changes to our Terms of Use, this Privacy Policy, or other policies or notices. We will disclose Identifiable Information when we are required to do so by law.

3. Separate Agreements.

Certain portions of the Site are restricted to users that have a separate agreement with us and other terms and conditions may apply to those services or products. This Privacy Policy shall not be construed to modify or alter any such separate agreement.

4. Legal

This Privacy Policy and the Terms of Use and all matters relating thereto shall be interpreted, governed, controlled, defined and enforced by, under and according to the laws of the State of Idaho, without reference to principles of conflict of law.  You consent to the jurisdiction and venue of any appropriate court in the State of Idaho to resolve such disputes. Use of the Site and any of the Applications is unauthorized in any jurisdiction that does not give effect to all provisions of this Privacy Policy and the Terms of Use. If any provision of this Privacy Policy or the Terms of Use is, for any reason, held to be invalid or unenforceable, the other provisions shall be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

A printed version of this Privacy Policy and the Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Privacy Policy and the Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is your express wish that this Privacy Policy and the Terms of Use and all related documents be written in English.
